
LABOR and EMPLOYMENT LAW
We provide our business and corporate clients with the full range of services required by employers. To assist our clients in managing their workforces, we design, prepare, and implement human resource policies and procedures, compensation programs, performance appraisal programs, alternative dispute resolution programs, employment manuals, employee handbooks, affirmative action programs, substance abuse programs, sexual harassment training, and preventive measures, agreements restricting unfair competition by departing employees, and protecting confidential and proprietary business information, and required workplace notices.
We are available to counsel our clients with respect to the entire host of issues likely to arise in the workplace such as employee selection and promotion, employee discipline and discharge, immigration and naturalization, equal employment opportunity, workplace injuries, disability, reasonable accommodation, safety and health, workplace privacy, wage and hour law, deferred compensation, and employee benefit plans. For those of our clients having workforces represented by labor unions, we assist in the administration of collective bargaining agreements including labor negotiations, grievance processing, labor arbitrations, Taft-Hartley benefit plan administration, and proceedings before the National Labor Relations Board and other administrative agencies. Where unions are not present or petitions for union representation are pending, we provide timely and invaluable assistance in maintaining union-free environments.
While we focus on preventive measures and risk management to allow our clients to operate their businesses efficiently, effectively, and without discord, crises do arise from time to time even with optimal preplanning. In those instances, we are available to assist our clients with immediate crisis intervention. Our attorneys are skilled and experienced in handling litigations in the federal and state courts and administrative agencies throughout New Jersey and its adjoining states. We are experienced in successfully defending actions brought by former employees raising claims such as wrongful discharge, discrimination, sexual harassment, whistle blowing, retaliation, and breach of contract.
We are also experienced in successfully representing employers before state and federal administrative agencies such as the New Jersey Division on Civil Rights, the U.S. Equal Employment Opportunity Commission, the U.S. Occupational Safety and Health Administration, the U.S. Bureau of Citizenship and Immigration Services (formerly INS), the U.S. Office of Federal Contract Compliance Programs, the National Labor Relations Board and the New Jersey and federal departments of labor. When necessary, we can promptly appear in courts or before administrative agencies on behalf of our clients to obtain injunctive relief to prevent unlawful labor strikes or picketing activities; to protect confidential and proprietary business information; to prevent unfair competition by departing employees or competitors; and, to protect client interests as appropriate.
