We counsel and represent individuals and businesses that are experiencing financial difficulties, as well as creditors of troubled individuals and businesses. We advise and assist individuals in protecting their assets from future liabilities, and structure business transactions to minimize the risk of the insolvency of other parties. We negotiate workouts of defaulted obligations for lenders and borrowers.
When financial problems cannot be resolved out of court, we represent debtors, landlords, creditor committees, trustees, and secured creditors in cases under Chapter 7 and Chapter 11 in Bankruptcy Courts throughout the region. We prosecute and defend lawsuits involving preferences, fraudulent transfers, and dischargeability of debts. We handle appeals from Bankruptcy Courts. We are experienced in state court insolvency proceedings, foreclosure litigation, and the application and litigation of the Uniform Commercial Code. We represent bidders and purchasers of assets and real estate from bankruptcy estates and other liquidation proceedings.
