Our experienced attorneys effectively counsel clients in a variety of environmental matters. Some of the services we provide are:

Transactional Counseling. In sale and lease transactions, we negotiate contract terms to promote and protect our clients' interests. We provide clients involved in purchases and sales of business entities and real estate with the knowledge needed to assure Industrial Site Recovery Act (SRA) compliance and the avoidance of unanticipated cleanup and toxic tort liabilities.

Permitting/Compliance. We counsel businesses of all types regarding compliance with constantly evolving federal and state regulations. We work closely with our clients to secure permits in all environmental media (air, water, waste) that will allow full compliance. Our attorneys coordinate and perform audits to assess environmental performance in areas such as air emissions, waste water discharges, hazardous waste management, occupational exposure, product development, worker and community right-to-know, and reporting and disclosure obligations, and advise clients as to compliance strategies.

Litigation. We litigate on behalf of companies faced with Superfund and state hazardous site enforcement proceedings and related insurance coverage disputes, including determination of responsible party for clean-up obligations. We also handle federal and state enforcement actions with regard to alleged violations of environmental laws.

Site Remediation. We advise clients concerning contractor and technology selection in remediation projections. We also advise and negotiate on behalf of clients for environmental liability and cost cap coverage insurance products. Our attorneys have a proven track record of negotiating cost-effective clean-up levels and techniques with regulators.

Policy Development. Our attorneys monitor and evaluate policy developments and work closely with clients to determine the impact of such developments. We evaluate proposed and newly adopted regulations which affect client operations and comment when appropriate.

Brownfields. Working with our land use and commercial real estate attorneys, our environmental staff has successfully led some of the first Brownfields projects under New Jersey's two and one-half year old Brownfields law, including obtaining state reimbursement of remediation costs. We advise clients concerning the economic incentives and liability protections offered under state and federal Brownfields programs and guide clients through the Brownfields process.
